Google, Facebook won't have to pay domestic tax under new IT rules

Appointment of grievance officer does not imply permanent establishment, say officials For digital multinationals such as Google, Facebook and Twitter, appointing grievance officers under new information technology (IT) rules does not imply that they have a “permanent establishment” in India. But if their local office performs business functions and contributes to revenue of the parent firm abroad, it may attract domestic taxes, said two people in the revenue department. This has come in the wake of foreign tech companies and others seeking legal advice on the tax implications of the government’s new IT order. They are required to appoint chief compliance officer, nodal officer and grievance officer from India. These firms fear that such appointments may attract income tax anywhere between 25 per cent and 40 per cent. “Creating any physical presence in the form of a grievance officer or a nodal officer, that too in compliance to government directions, will not create any business...

Apple cannot block pre-installed apps removal under antitrust reform bill

The proposal is part of a package of bipartisan bills that would impose significant new constraints on how tech companies operate, restricting acquisitions and forcing them to exit some businesses Apple Inc. would be prohibited under antitrust reform legislation introduced last week from giving its own apps an advantage by preventing users from removing them on Apple devices, said Democratic Representative David Cicilline, who is leading a push to pass new regulations for U.S. technology companies. Cicilline told reporters Wednesday that a proposal prohibiting tech platforms from giving an advantage to their own products over those of competitors would mean Apple must let consumers decide which apps to use or remove. “It would be equally easy to download the other five apps as the  Apple  one so they’re not using their market dominance to favor their own products and services,” the Rhode Island Democrat said. The proposal is part of a package of bipartisan bills that wo...

US antitrust case against Google mimics lawsuit that attacked Microsoft

Shares of Google parent Alphabet Inc. rose after the complaint came out as analysts argued getting rid of the payments may save the company money The U.S. government’s antitrust case against Google follows a similar path to its attack on Microsoft Corp. more than 20 years ago — and that should make the internet giant nervous. The suit focuses on payments Google makes to ensure its search engine is the default on mobile phones and web browsers. Google’s dominant market share and massive revenue allows it to spend billions of dollars a year on these deals, blocking out competitors from the valuable placements and limiting consumer choice, the Justice Department alleged. It’s a similar argument the government made against Microsoft when it alleged in 1998 that the software company was requiring computer makers to set its web browser as the default on their machines. That lawsuit dragged on for years, distracted executives and helped Microsoft competitors — Google among them. Shares ...
